ThrivePot is committed to protecting your privacy. This policy explains how we collect, use, and protect your information.

Information we collect

We collect your phone number for authentication. We collect transaction data to maintain your care fund balance, including gifts received and card activity. We do not share details of how you spend your care funds with donors, employers, or any third parties. Your spending is visible only to you.

How we use your information

We use your phone number to send one-time login codes for account access. We use transaction data to maintain your fund balance and send gift notifications. We never sell your personal information to third parties.

What donors can see

Donors can see that their gift was received and is being used for care. They cannot see what you spend it on, where you spend it, or any details about your mental health care. Your privacy is total.

Data security

We use industry-standard encryption to protect your data. Your care fund is powered by Stripe, a PCI-compliant payment processor. Authentication is handled by Supabase with encrypted phone OTP.

SMS communications

ThrivePot uses SMS to send one-time login codes for account access. By providing your phone number you consent to receive these authentication messages. Message and data rates may apply. Message frequency varies based on your account activity. Reply STOP to opt out at any time, or HELP for assistance.

Terms of Service

Please read these Terms of Service ("Terms") carefully before using ThrivePot. By creating an account, accessing, or using ThrivePot (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service. ThrivePot is operated by Nafiz Elgun LLC ("ThrivePot," "we," "us," or "our").

1. Eligibility

You must be at least 18 years old to create a ThrivePot account or use the Service. By using ThrivePot, you represent that you are 18 or older and have the legal capacity to enter into these Terms. We may suspend or terminate accounts created by anyone under 18.

2. What ThrivePot Is

ThrivePot allows individuals ("Recipients") to receive funds from friends, family, and other supporters ("Donors") to pay for mental health care, including therapy, psychiatric care, prescriptions, and approved wellness apps. Funds are restricted-use and intended only for approved mental health care providers and merchants. ThrivePot is not a bank, is not FDIC insured on its own, and is not a substitute for professional medical, psychiatric, or financial advice.

3. Accounts

You are responsible for your account credentials and all activity under your account. ThrivePot uses phone number verification (SMS one-time codes) as its primary authentication method. You are responsible for maintaining control of your phone number.

4. Gifts and Funds

For Donors: Gifts are voluntary and non-refundable. Donors do not retain ownership or control over funds once gifted.

For Recipients: Funds are restricted-use; ThrivePot may decline transactions outside approved categories and does not guarantee uninterrupted availability. Card transaction data is used solely to operate your account and is never shared with donors or third parties.

Fees: ThrivePot charges a transaction fee on gifts as disclosed at the time of transaction.

No Cash-Out: Funds are not redeemable for cash and may not be transferred to another person except as the Service expressly allows.

5. Privacy and What Information Is Shared

ThrivePot collects transaction data including gifts received and card activity to operate the Service. Donors can see that their gift was received and is being used toward care β€” never what it was spent on or where. Your spending details are never shared with donors, employers, or third parties. In the event ThrivePot is merged with, acquired by, or sold to another company, your data will remain protected under the commitments in this policy. Any successor entity will be required to honor these same privacy terms. We will notify users of any material changes to how their data is handled before those changes take effect.

6. Card Use

Any card ThrivePot issues is restricted to approved mental health-related merchant categories. You agree not to attempt to circumvent these restrictions, transfer the card to another person, or use it for any purpose other than your own mental health care.

7. Prohibited Conduct

You agree not to use the Service unlawfully, misrepresent your identity or age, attempt to circumvent spending restrictions, solicit funds under false pretenses, interfere with the Service, or attempt unauthorized access to other accounts. We may suspend or terminate accounts that violate these Terms.

8. No Medical Advice

ThrivePot is not a healthcare provider and does not give medical or therapeutic advice. Any provider directory is informational only. If you are experiencing a medical or mental health emergency, call 911. If you are in crisis, call or text 988 (Suicide & Crisis Lifeline).

9. SMS Communications

By providing your phone number, you consent to receive SMS messages from ThrivePot related to account verification and service notifications. Message and data rates may apply. Message frequency varies based on your account activity. Reply STOP to opt out at any time, or HELP for assistance.

10. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, ThrivePot is not liable for indirect, incidental, or consequential damages. Our total liability for any claim shall not exceed the greater of the amount you paid ThrivePot in the prior 12 months, or $100.

11. Changes & Termination

We may modify or discontinue the Service at any time, and may update these Terms with notice through the Service or by email. You may close your account at any time; we may suspend or terminate accounts that violate these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts located in Anne Arundel County, Maryland.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ThrivePot regarding the Service.
